Packiteco is an online trading platform for biodegradable and environmentally friendly products. Users may apply to create an account as a supplier or as a purchaser and in doing so you will be agreeing to accept these terms and conditions in full. If you do not accept these terms then you will not be able to use the site.
Packiteco is a marketplace venue which allows purchasers and suppliers who comply with Packiteco policies to deal directly with each other to offer, sell and buy goods. Packiteco is not directly involved in the transaction between buyers and sellers and has no control over the quality, safety or legality of any aspect of the items listed, accuracy of the listing, ability of the seller to sell items, or ability of buyers to pay for items. Transaction details are stored in a secured database.
To register for either a Supplier Account or Purchaser Account you must be 18 years old or over. By agreeing to these terms and registering for an account you are confirming that you are at least 18 years of age. In Submitting a request for either a Supplier Account or Purchaser/ Customer Account you must provide only accurate and up to date details, hold appropriate authorisation to open such account and to use the selected payment method. If you are registering an account for a company or other legal entity, you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms.
If you register for a Supplier Account we will ask you for details about your company, your approach to sustainability and the products you want to register for sale here. As a supplier you agree to provide accurate listing information for your products, and to fulfil all orders placed through this site at the agreed sale price, and to deliver to the location specified on the sales order in a timely manner. Any change in the details submitted to us during registration must be communicated to us immediately and may impact upon the account terms we offer. Product listing will be subject to receipt of the appropriate registration fee, determined by the information you supply.
If you register for a Purchaser/ Customer Account, you will need to provide basic details about you and any company or organisation that you represent. You will be responsible for any use of this site and any orders placed here so keep your username and password secure and do not permit any other person to use your username or password. If you realise that any unauthorised use of your password or a security breach has occurred you must let us know immediately.
We do not own the items listed for sale on the site.
In placing an order you undertake that the details you provided are accurate and up to date, that you are authorised to use the credit or debit card used for the order and that sufficient funds are available to cover the costs of the goods. The costs of foreign products may fluctuate and all prices advertised are subject to such changes.
All orders are subject to availability and confirmation of the order price and any additional delivery charge. Where applicable, delivery charges are clearly displayed and included in the ‘Total Cost’. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract will not be formed until you are sent a confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
Despite all reasonable efforts, occasionally items may be listed at an incorrect price or with incorrect information. If this happens, we will notify you as soon as possible and give you the option to change the order for the correct details, or to cancel. If we are unable to contact you, we may cancel the transaction, even after it is completed and a payment has been processed. If we do this, we’ll promptly arrange for any payment to be credited or refunded.
In placing items for sale on our site you undertake that you hold the relevant licenses and authorisations to offer such items for sale, that the items are produced from biodegradable and environmentally friendly materials and produced in such a way as to limit any negative environmental impact. You will provide accurate and clear product descriptions, free from ambiguous or misleading content. Should any changes be made to the product offered, you will immediately update the product description and, if any product is no longer available, you will notify us as soon as possible.
Orders for goods offered by you for sale on this site will be transmitted to you by email or an interface. You undertake to dispatch the ordered items in the quantity requested and paid for, within the agreed timescale to the address requested on the order. If any part of the order cannot be fulfilled you will notify the purchaser, offering either an alternative solution or a refund for that part of the order which cannot be completed.
As a marketplace venue, Packiteco’s role is to connect buyers with sellers. As a buyer, when you place an order on Packiteco, you enter into a transaction with a seller, facilitated by Packiteco. We are committed to providing a positive experience for both parties in every transaction on our marketplace. The following describes and explains our Transactions Policy:
- Seller lists item for sale. Price includes shipping and sales tax if applicable.
Buyer purchases item with credit card, debit card, or PayPal.
Packiteco notifies seller of sale.
Seller confirms that s/he will fulfill the order.
Packiteco transfers funds to the seller.
Seller ships item to Buyer.
Buyer receives item.
A transaction is created when a buyer has completed the checkout process on Packiteco. Both the buyer and the seller are sent an email from Packiteco about the order and a receipt record in their Packiteco account. A transaction is considered complete after the buyer has submitted payment and the seller has shipped the item to the buyer.
Buyer has a limited period of time from the date of purchase to report a problem and seek Packiteco’s assistance to resolve any issues related to the transaction. Communication from a buyer or seller can extend the eligibility period.
We value your information and take reasonable precautions to protect it. While using Packiteco, you may also become aware of confidential information about us or another member. You promise to not disclose any confidential information made available to you through Packiteco to any other person.
You have control of your information and can review or edit your account information, including your marketing preferences, location data, mobile choices, and search history, within your Account Settings.
You must not use data collected from our website to contact individuals, companies or other persons or entities.
PACKITECO’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS PROVIDE PACKITECO'S WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. PACKITECO'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND PACKITECO'S SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM PACKITECO SHALL CREATE ANY WARRANTY.
German law is applicable. With regard to the legal relationships with consumers, this choice of law is applicable only if this does not affect the protection offered by the mandatory provisions of the law in the state in which the consumer has his usual residence.
If the customer has no general place of jurisdiction in Germany or if the customer is a merchant within the meaning of the German Commercial Code (HGB), the place of jurisdiction for all legal disputes shall be the registered office of Packiteco. Packiteco is also entitled to sue at the general place of jurisdiction of the customer.
The regulations of the UN Convention on Contracts for the International Sale of Goods are explicitly not applicable.
Due to the nature of the Internet, we cannot guarantee the continuous and uninterrupted availability and accessibility of the platform. We may restrict the availability of the site or certain areas or features of it should this is necessary in view of capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the site. Packiteco may improve, enhance and modify the site and introduce new services from time to time. Save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if we stop publishing the website.
Packiteco reserves the right to modify these Terms at any time in accordance with this provision. If we make changes to these Terms, we will post the revised Terms on the Packiteco Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of the modifications by email at least thirty (30) days before the date they become effective. If you disagree with the revised Terms, you may terminate your Agreement with immediate effect. We will inform you about your right to terminate the Agreement in the notification email. If you do not terminate your Agreement before the date the revised Terms become effective, your continued access to or use of the Packiteco Platform will constitute acceptance of the revised Terms.
